  2. Supervisory authority: The authority responsible for supervising compliance with consumer protection legislation is the Slovak Trade Inspection (SOI), Inspectorate of the Slovak Trade Inspection for the Bratislava Region, Bajkalská 21/A, P. O. BOX No. 5, 820 07 Bratislava 27 (or the relevant inspectorate according to your registered office).

Article II.

Nature of Coaching and the Relationship Between the Coach and the Client

  1. Coaching is a collaborative and creative partnership between the Coach and the Client, the aim of which is to support the Client in maximising their personal and professional potential. Coaching may address various areas of the Client’s life, including relationships, work, self-confidence, setting boundaries, emotional patterns, beliefs, decision-making, overall wellbeing and personal development. Its purpose is to bring deeper awareness, identify blocks and support the Client in making and implementing their own decisions.

  2. The Client bears full responsibility for their own decisions, choices, actions and results arising from the coaching process. The Coach does not make decisions on behalf of the Client and does not guarantee any specific personal, professional, financial, relationship-related or other results.

  3. The Client acknowledges and agrees that coaching is not psychotherapy, psychological counselling, medical care or the provision of healthcare services within the meaning of the applicable laws of the Slovak Republic. Coaching does not diagnose, treat, prevent or eliminate mental illnesses, disorders or other health conditions. Where necessary, it is the Client’s responsibility to seek professional assistance from a qualified doctor, psychologist or psychiatrist.

  4. Successful coaching requires the Client’s active participation. The Client undertakes to communicate openly and truthfully, approach feedback with an open mind and dedicate reasonable time and energy to fully participating in the Programme.

  5. Depending on the selected Programme, the Client may receive recommended exercises, meditations, reflection questions or other practices between sessions. The Client acknowledges that lasting change generally requires work and the application of insights outside the scheduled sessions themselves.

  6. If the Client is uncomfortable with any exercise, question, method or the course of a session, they are encouraged to communicate this openly to the Coach at any time.

Article III.

Ordering Services and Form of Provision

  1. The Services are specified on the Service Provider’s website www.boutiquecoaching.com, in the booking system, confirmation email, invoice or individual agreement.

  2. The contract for the provision of Services between the Service Provider and the Client is concluded upon confirmation of the order by the Service Provider and/or payment of the price of the Service by the Client.

  3. The standard duration of one coaching session is 60 minutes, unless otherwise agreed in writing.

  4. The Services are provided primarily online (via video call) and are available to Clients internationally. In-person sessions in Bratislava are possible only by prior express agreement.

  5. Given that the Coach regularly travels for the purpose of conducting workshops, retreats, professional training and other work-related activities, the Client acknowledges that sessions originally agreed to take place in person may, in justified circumstances, be conducted online. A temporary change in the place of residence or stay of either the Coach or the Client does not affect the continuity or validity of the Programme.

Article IV.

Price and Payment Terms

  1. The Client undertakes to pay the price for the selected Service or Programme according to the current price list stated in the offer, on the website www.boutiquecoaching.com or on the issued invoice.

  2. Payment may be made as a single payment in advance or, where expressly offered by the Service Provider for the relevant Programme, in agreed instalments.

  3. The option to pay in instalments constitutes the spreading of the total price of the complete Programme over time; it is not a subscription or the purchase of separate individual monthly services. The Client undertakes to pay all agreed Programme instalments regardless of how quickly the individual sessions are used.

  4. Payments must be credited to the Service Provider’s account no later than on their due date. In the event of late payment, the Service Provider is entitled to suspend the provision of Services until the outstanding amount has been paid in full.

Article V.

Rescheduling and Non-Attendance Rules (Cancellation Policy)

  1. Individual sessions: An agreed session may be rescheduled free of charge no later than 24 hours before its scheduled start time. If the Client cancels a session less than 24 hours before the scheduled time or fails to attend the session without notice, the session shall be considered duly used, with no entitlement to a refund or replacement session.

  2. Coaching Programmes: The 24-hour rule also applies to rescheduling sessions within a complete Programme. In the event of late cancellation (less than 24 hours before the session) or non-attendance, the session shall be forfeited and deducted from the total number of sessions included in the Programme.

  3. Exceptional circumstances: In the event of demonstrable sudden emergencies, sudden serious illness or force majeure, the Coach may, at their sole discretion, offer the Client a replacement session even where notice was given later.

  4. Changes by the Coach: If the Coach is required to reschedule a session for serious reasons, the Coach undertakes to offer the Client a replacement session as soon as reasonably possible without any reduction in the agreed scope of the Services.

Article VI.

Duration of Programmes and Period for Their Completion

  1. Coaching Programmes are designed to be completed within the timeframe specified at the time of purchase. To accommodate holidays, travel, ordinary illnesses and other unforeseen circumstances, the Service Provider provides a reasonable extension period.

  2. Maximum period for completion of the Programme (extension):

  • Pattern Reset (standard duration 6 weeks): extension of up to 1 additional month

  • Return to Self (standard duration 3 months): extension of up to 1 additional month

  • Feel the Joy (standard duration 6 months): extension of up to 2 additional months

  • Break Free (standard duration 12 months): extension of up to 3 additional months

  1. Any unused sessions that the Client does not attend within the specified maximum duration of the Programme (including the extension period) shall expire without compensation after the expiry of that period, unless otherwise agreed in writing between the parties for reasons deserving special consideration.

Article VII.

Consumer’s Statutory Right to Withdraw from the Contract (Within 14 Days)

  1. If the contract is concluded at a distance (via the internet), a Client who is a Consumer has, pursuant to Act No. 108/2024 Coll. on Consumer Protection, the right to withdraw from the contract without giving any reason within 14 calendar days from the date on which the contract was concluded.

  2. The Client may exercise the right to withdraw from the contract in writing or by email sent to the Service Provider’s contact address.

  3. Commencement of the provision of Services before the expiry of the 14-day period:

  • If the Client requests the commencement of the provision of Services (scheduling of the first session) before the expiry of the statutory 14-day withdrawal period, the Service Provider requires an express declaration from the Client confirming that the Client has been duly informed of the right to withdraw from the contract.

  • The Client acknowledges that, once the Service has been fully provided (for example, in the case of a single session), the right to withdraw from the contract expires.

  • If the Consumer withdraws from the contract after having consented to the commencement of performance before the expiry of the withdrawal period, the Consumer is obliged to pay the Service Provider for the performance actually provided up to the moment the notice of withdrawal is delivered (i.e. the proportionate amount for sessions already completed).

  1. Nothing in these Terms and Conditions excludes or restricts the mandatory rights of the Consumer guaranteed by the applicable laws of the Slovak Republic.

Article VIII.

Contractual Termination of the Programme and Cancellation Terms (Beyond Statutory Rights)

  1. Pattern Reset Programme: Given that this is a short-term, intensive 6-week Programme, the additional contractual termination option set out in point 2 of this Article of the Terms and Conditions does not apply. The Consumer’s statutory right to withdraw from the contract within 14 days remains unaffected.

  2. Programmes with a duration of 3 months or more:

  • The Client has the contractual right to terminate a long-term Programme by written notice at any time during the first 60 days from the Programme start date.

  • In such a case, a one-month notice period applies, commencing on the date on which the notice of termination is delivered.

  • During this notice period, the Client remains entitled to use the agreed sessions.

  • Upon expiry of the notice period, the Service Provider shall refund to the Client any amount paid in advance attributable to individual sessions not yet used, calculated in accordance with the pricing structure of the relevant Programme.

  • Sessions that have already taken place, been missed or been cancelled less than 24 hours before the scheduled time shall be considered used and their price shall not be refunded.

  1. After the expiry of the first 60 days, the Programme is non-refundable and the Client is bound by the contract for the entire agreed scope of the Programme (including the obligation to pay any remaining instalments), unless the parties agree otherwise in writing on the basis of exceptional and demonstrable personal circumstances.

  2. These contractual termination terms constitute a voluntary additional benefit provided by the Service Provider alongside the Client’s statutory rights.

Article IX.

Support Between Sessions (Between-Session Support)

  1. Where expressly included in the selected Programme, the Client may contact the Coach between sessions with brief questions or reflections relating to the topics being addressed.

  2. Between-session support serves as a supplement to regular sessions and under no circumstances replaces a coaching session itself.

  3. Responses are generally provided during normal working days within a reasonable period of time.

  4. Between-session support does not constitute a crisis, acute care or emergency service. In the event of an acute psychological or personal crisis, the Client is required to contact crisis intervention services or the emergency number 112.

Article X.

Confidentiality and Personal Data Protection

  1. The relationship between the Coach and the Client, as well as all information provided by the Client during the coaching process, is subject to strict confidentiality.

  2. The Coach shall not disclose any confidential information concerning the Client to any third party without the Client’s prior express consent, except where such an obligation arises directly from the law (for example, a statutory reporting obligation in the event of suspected criminal activity) or where there is an immediate risk of serious harm to the life or health of the Client or another person.

  3. The Client acknowledges that confidentiality in coaching is not equivalent to legally protected attorney-client or medical confidentiality.

  4. Where the Client’s coaching is paid for by an employer or a third party, the content of individual sessions remains confidential between the Coach and the Client unless otherwise agreed by the parties in writing.

  5. Topics and model situations arising from coaching may be used for the Coach’s professional supervision, mentoring and professional development, but always exclusively in a fully anonymised form and without any information identifying the Client.

  6. The Client’s name, photograph, review (testimonial) or personal story shall never be publicly published without the Client’s prior consent.

  7. The processing of the Client’s personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, and Act No. 18/2018 Coll. on Personal Data Protection, as amended. Detailed personal data protection principles are published in a separate document on the Service Provider’s website.

Article XI.

Intellectual Property and Copyright

  1. All materials, worksheets, exercises, meditations, recordings and other materials provided to the Client in connection with the provision of the Services are copyrighted works protected under Act No. 185/2015 Coll. (Copyright Act) and are intended exclusively for the Client’s personal use.

  2. Without the Service Provider’s prior written consent, it is prohibited to copy, distribute, publicly publish, sell, transfer to third parties or use for any commercial purpose any materials or other resources provided to the Client in connection with the provision of the Services.

Article XII.

Liability for Damage

  1. Except for expressly agreed obligations, the Coach provides no warranties or guarantees regarding specific results of coaching within the Services provided. The Client assumes full responsibility for their own actions and decisions.

  2. To the maximum extent permitted by the applicable laws of the Slovak Republic, the Service Provider shall not be liable for indirect, consequential or incidental damages, loss of profit or harm arising as a result of the Client’s decisions or actions.

  3. Nothing in these Terms and Conditions excludes or limits the Service Provider’s liability for damage caused intentionally or through gross negligence, or any liability that cannot be excluded by law.

Article XIII.

Dispute Resolution and Alternative Dispute Resolution (ADR)

  1. The parties undertake to resolve any misunderstandings and disputes primarily by mutual agreement and constructive communication in good faith. If a dispute cannot be resolved directly, the parties may consider mediation before commencing court proceedings.

  2. Consumer information regarding ADR:

  • If the Client (Consumer) is dissatisfied with the manner in which a complaint has been handled or believes that the Service Provider has infringed their rights, the Client has the right to contact the Service Provider with a request for remedy.

  • If the Service Provider rejects this request or fails to respond within 30 days of its submission, the Consumer has the right to submit a proposal for the initiation of alternative dispute resolution to an alternative dispute resolution entity (ADR) pursuant to Section 12 of Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes and on Amendments and Supplements to Certain Acts, as amended.

  • The competent ADR entity is the Slovak Trade Inspection (SOI) or another competent authorised legal entity included in the list of ADR entities maintained by the Ministry of Economy of the Slovak Republic. The Consumer has the right to choose which of the listed alternative dispute resolution entities to contact.

  • The Consumer may use the online dispute resolution platform (ODR) to submit a proposal for the alternative resolution of their dispute, as specified in the Slovak version of these Terms and Conditions.

Article XIV.

Governing Law and Final Provisions

  1. These Terms and Conditions, as well as all legal relationships arising between the Service Provider and the Client, are governed by the laws of the Slovak Republic.

  2. These Terms and Conditions, together with the Programme description, booking confirmation, invoice and any individual written agreement, constitute the entire agreement between the Service Provider and the Client. Any individual amendments or special agreements must be made in writing.

  3. Given that the Service Provider also provides Services internationally, Consumers habitually resident in another country may benefit from the protection afforded by the mandatory provisions of the laws of their country of residence, which cannot be contractually excluded.

  4. If any provision of these Terms and Conditions becomes invalid or unenforceable, the validity and effectiveness of the remaining provisions shall remain unaffected.

  5. Acceptance of the Terms and Conditions:

BY PAYING THE PRICE FOR THE SERVICES OR A DEPOSIT FOR A PROGRAMME PROVIDED BY THE SERVICE PROVIDER, THE CLIENT CONFIRMS THAT THEY HAVE DULY READ THESE GENERAL TERMS AND CONDITIONS, UNDERSTOOD THEM AND AGREE TO THEM IN FULL.

  1. Language versions:

These Terms and Conditions are available in Slovak and English. In the event of any discrepancy, inconsistency or difference in interpretation between the Slovak and English versions, the Slovak version shall prevail.
